You should also consider that a majority in one region might not represent a majority in the entire US.

DOMA was national.Gawdzilla Sama wrote:You should also consider that a majority in one region might not represent a majority in the entire US.
California is a discrete sovereignty with a legislature in Sacramento, and people who vote for propositions as a democracy.
I'm in favor of the majority of Californians being restricted by the equal protection clause of the US constitution. I'm in favor of that check on democracy.

For 99% of laws passed in a democracy, they are passed by the legislature. The legislature is elected by the people.Gawdzilla Sama wrote:Then it wasn't done by a majority of voters. Simples.
It's nice to have constitutional limitations on those democratically elected folks, innit?

No its appalling, if the people want a moronic society then they should be allowed it and if you are minority in such a society its time to get out fast. Having unelected politicians overruling (the fact they voted 5 to 4 shows its not a legal or constitutional matter its a political one ) is tyranny. A tyranny of a majority is a contradiction in terms only minorities can ever rule by absolute powerCoito ergo sum wrote:For 99% of laws passed in a democracy, they are passed by the legislature. The structure is in our Constitution, so it's not some weird tyrannical enactment.MrJonno wrote:No its appalling, if the people want a moronic society then they should be allowed it and if you are minority in such a society its time to get out fast. Actually, until it is cast down by a complete collapse of the State, or by being Amended out of existence, the US Constitution IS the ultimate authority in that state.MrJonno wrote:Constitutions are not the ultimate authority people are and if they aren't elected its tyrannyThe structure is in our Constitution, so it's not some weird tyrannical enactment.
