Even if it were possible to prove that this is his hand, it is still meaningless.
1. It doesn't prove that the gun was illegally held, or that he was holding it in any illegal circumstance, and he will be under no obligation at all to answer questions about it. It is not pertinent to the case at all.
2. If they head video footage of him firing off a fully automatic machine gun, it would still have no bearing.
