Yes, a threat to kill can be a crime, if it is serious, but it's not always a crime. Yelling, "I'll fucking kill you!" as an expletive is not a crime. It depends.

Wishing someone dead is most certainly not, however, a crime. Wishes are never crimes. Even wishing the President dead is not a crime.

The teacher may have felt threatened by it. It's not just a private matter for the parents to deal with when it's made public on Facebook and involves a teacher.

Even if it was just a disrespectful statement, schools have a legitimate need to maintain discipline and order, and such comments about the staff of the school can erode that discipline. I support a lot of leeway in schools disciplining students for stuff like this.

Moreover, I wholeheartedly oppose the statements of the mother in this case. Even if I, as a parent, disagreed with the punishment, I would respect it.
