In US law 'libel' is defamation in print, while 'slander' is defamation in speech.

The revolting gasbag has been making that accusation since the beginning of the trial, if not before. Under US law the judge can be considered a 'public figure' and therefore has a higher burden of proof if he chose to sue. The accusation is definitely defamatory in my opinion. For a suit to get anywhere the judge would have to prove that the convict former president made the accusation with 'actual malice' i.e. knew the accusation to be false or made it with 'reckless disregard' for its truth or falsehood.

Hmm. The malice of the charge is selfevident, and as for the truth, well, putting the Trumpian alternative reality aside, though that would be a matter of specifics in most normal circumstances, Trump doesn't seem bothered by whether that or similar accusations are actually true or not because they're issued within the context of a confabulation that makes him both the hero and the victim of his self-authorising narrative.

I'd say that malice is a motivation for him in most of the things he says and does. 'Actual malice' on the other hand is a specific term in US defamation law as described in my previous post. In any case he's consistently spouting shit with 'reckless disregard' for the truth. The judge may theoretically have a good case but I doubt he wants to entangle himself further with that greasy waste of space. The old 'don't wrestle with a pig' principle.

Nate Cohm points out that Trump’s current polling lead relies on voters who have traditionally supported Democrats, including younger and nonwhite voters. Some of them have previously told pollsters that a conviction would make them less comfortable with supporting Trump. Nate also emphasizes — and this will sound familiar — that nobody yet knows what will happen.

A third of republicans doesn’t translate to consistently leading in polling does it?

Whatever, we’re going to learn all about it after Biden wins and these polls are used to “show” the election was rigged.

He now seems to be framing the conviction as a conflict between the rule of law and his personal political power - power he's said he'll use to bend the law to reap vengeful retribution on those who do not acknowledge his brilliance and potency.
