It's going really badly for Trump lawyer Sauer. He is saying a president has to impeached, then convicted later in court. He is standing in a court saying they, and all courts, have no power. Seems like the justices would all be a bit shocked with that.

But in arguments lasting more than 2 1/2 hours in the court’s first consideration of criminal charges against a former president, several conservative justices indicated they could limit when former presidents might be prosecuted, suggesting that the case might have to be sent back to lower courts before any trial could begin.

Likely scenario: SC leaves immunity undecided and throws immunity back to judge Chutkin. It then buys Trump time to the election.
Election happens. Biden wins. Case goes to court without Trump immunity. Court has then done a favor to Trump in that they did not decide it. Trump wins? It remains undecided, Trump rules and commits more crimes as president.

Elsewhere, on Trump immunisty at SC
There is an appeal to the highest court in the land in respect of a case, but they are terrified of hearing any mention or evidence about that case that cannot be named. What is it about that case that makes them shrink from the light like vampires.
This is an example of hypocritical flip-flopping that we see all the time from the conservative majority.
They aren't the most elite legal minds in the country. They just demand that we all treat them as such. What scares me is how many law professors are still willing to idolize Supreme Court justices. They talk about them as if the justices were priest-monarchs whose reasoning and integrity are above reproach. That said, most Constitutional Law professors are unironically in a twist because the Roberts court has invalidated so much of what's been taught for decades as bedrock constitutional jurisprudence questions.
