He's correct, the Constitution has nothing to say about abortion, nor about any right to privacy. That is an "implied" right based on the 1st, 4th, and 5th Amendments. Tying a medical procedure to self incrimination or illegal search and seizure is tenuous at best.

The 9th Amendment is applicable here as well or it is indeed as Bork claimed, no more relevant to any rights than an inkblot. The US Supreme Court has been ruling in favor of the right to privacy in regard to questions not mentioned in the Constitution for about the past 100 years (source).

No, it's not simple at all. There is a complex spectrum of views on this issue, ranging from the simplistic view of the trans-phobic right "they are guys pretending to be women, end of story" to the totally PC, also simplistic view "they are women in all respects, and any attempt to even slightly differentiate them from other women is hateful".

The real point is how they should be treated by other people and society in general. Clearly with respect, and a recognition that they sincerely identify as women. Most people not lost in the troglodyte past have no difficulty in doing so now, just as somewhat earlier the zeitgeist moved in terms of respecting gay people.

The only area that is potentially problematic is trans women competing with other women in elite sport. It is not trans-phobic for born female competitors to feel that their playing field may not be level. To me, it should be up to the participants in any given sport - some sporting competitions will accept trans women into their sport, some may vote against, but only on the basis of ensuring no unfair advantage, not from simple prejudice.

All the other competitors (females) could have objected beforehand, and chose not to. They accepted the competition as fair.

So Lia accepted herself as a woman, and transitioned to female, and lived her life as a woman, and her family, friends, colleagues, and everybody else accepted her as a woman, and then she "bumped into the reality of the situation" when some right-wing transphobes got #OUTRAGED for cilcks. Poor kid.

It depends on how you define male. If they've had surgery they may no longer have male bits. Hormonally they may be more female than male. Genetically they will be what they originally were, but that's not a certainty that they were XY in the first place.

I'm interested in why you are so concerned about the trans issue. And why you only seem to care about trans women and not trans men..
