University Vaccine Mandate Stays as Justice Barrett Rebuffs Plea
U.S. Supreme Court Justice Amy Coney Barrett turned away a challenge to Indiana University’s requirement that all students be vaccinated against Covid-19 for the fall semester unless they have a religious or medical exemption.
Giving no explanation, Barrett on Thursday summarily denied a request to block the vaccine mandate from eight students who said their constitutional rights were being violated.
The case marked the first time the nation’s highest court has acted on a vaccine mandate. It comes as universities and employers across the country are moving to require Covid inoculations in an effort to stem the rapid spread of the Delta variant.
Barrett, the justice who takes the first look at emergency matters from Indiana, acted alone and chose not to refer the request to the full nine-member court. She denied the request without asking the university to file a response.
I wonder if it's because public health is a state power. Not a lawyer, so...

Interesting. Most public health issues here are also state powers. The Federal government is responsible for quarantine of people coming from overseas, and for buying those vaccines we cannot make here. Workplace laws, now a focus because of issues around mandating vaccination, have both federal and state components.
In Oz, a public servant called the Chief Health Officer (one per state) has sweeping powers in a pandemic; state governments basically follow their advice. State governments also decide everything about the closure of state borders, which pisses the feds off, but they cannot do anything about it...

The states here have that setup. The CDC has guidelines, and many states do not have the technology that the CDC has. But state health officials in states like CA can just ignore the CDC. If it is an ebola thing, the CDC will fly patients out of state.

Here, the States in general have been more gung ho than the feds in establishing lockdowns, mask wearing etc; we don't have the state equivalents to Texas or Florida. In comparison, the Federal Government, which is hamstrung by a conservative rump, has been somewhat indecisive at times, and bungled quick acquisition of vaccine supplies...

I just watched some poor guy's heartfelt rant about his wife having to leave the hospital without her cancer treatment to make room for covid patients, specifically for unvaccinated patients. He suggested they deal with the hoax at home rather than running to fake medicine for help. It's hard to disagree.

It did not help then.
Third level education starts next week with no masks and no social distancing. 70% of students are vaccinated at least once and many went for Jansen vaccine as it only requires one jab.
