On the plan to rebuild US infrastructure, what every single person involved knew would happen has happened. Biden made the gesture of trying to get Republicans to work with him. They played along in the only way they can, by trying to gut the proposals.

They may claim that he never intended to listen to their position of 'no, we can't agree to this because you're trying to help regular citizens while reversing some of our tax cuts to corporations and the wealthy', but they can't claim that he made no effort to get their cooperation. If this bill passes it looks like it will follow the same path as the pandemic relief bill, with no support from Republicans.

'Biden Ends Infrastructure Talks With Senate GOP Group, Saying Its Plan Fell Short'
Democrats and Republican have been unable to agree on how to pay for the package. Democrats have proposed raising the corporate tax rate, but Republicans, who oversaw tax cuts to the richest Americans, have balked. They want to pay for the package through user fees. The White House has dismissed that idea, insisting that it amounts to a tax on Americans making less than $400,000, the income at which Biden's tax increase would begin.

More 'yeah, you know, Bill Barr and Trump were actually right' dick waving from the Biden Justice-fucking-Department. I think it's becoming clear that there is an institutional ethos there that openly supports the imperial presidency.

The theory here is that the president of the US is immune from defamation lawsuits and can say whatever scurrilous lies he likes because it's part of his job to say things in public. I haven't read the brief, but it looks like they simply ignore a previous ruling by a US District Court judge who said, 'commenting on the operation of government is part of the regular business of the United States, commenting on sexual assault allegations unrelated to the operation of government is not.'

'Biden Justice Department requests to replace Trump in E. Jean Carroll lawsuit'
The Justice Department on Tuesday sought to substitute itself for former President Donald Trump in a defamation lawsuit filed by writer E. Jean Carroll.

Justice Department lawyers said in a brief filed Monday that Trump was acting "within the scope of employment" of the government when he accused Carroll of lying to sell books by alleging that he sexually assaulted her in the 1990s.

"Then-President Trump's response to Ms. Carroll's serious allegations of sexual assault included statements that questioned her credibility in terms that were crude and disrespectful," Brian Boyton, acting head of the Justice Department's Civil Division, wrote in the brief. "But this case does not concern whether Mr. Trump's response was appropriate. Nor does it turn on the truthfulness of Ms. Carroll's allegations."

In the briefing, the Justice Department lawyers noted that "speaking to the press on matters of public concern is undoubtedly part of an elected official's job."

"Courts have thus consistently and repeatedly held that allegedly defamatory statements made in that context are within the scope of elected officials' employment -- including when the statements were prompted by press inquiries about the official's private life," they wrote.

The lawyers also acknowledged that Trump's comments about Carroll "attacked her appearance, impugned her motives and implied that she had made false accusations against others" and were ultimate "without question unnecessary and inappropriate."

However, they argued the comments "all pertained to the denial of wrongdoing" and "cannot be clearly severed" from the fact that they remained within the limits of the scope of his employment.

Wow, Manchin is no dummy. There are actually some things to work out regarding elections:

He said that he would not support the “For the People Act,” which would override hundreds of state laws governing elections, federalize control of voting and elections to an unprecedented degree, and end two centuries of state power to draw congressional districts.

That last bit is what the Supreme Court would strike down. States run elections, and make the districts. They have also set up the winner take all systems.
