Neither. In Australia sentencing reflects how rape as an offence is regarded. It's just what men do, you know? In other words, rape culture.

We do have some standards, though. Raping prepubescents is out. Sort of. In March 2016 Gary Brabham, son of three times formula 1 world champion, Jack, was found guilty of one count of rape and one count of indecent treatment in March. The victim was a six years old girl. He was sentenced to 18 months and released after six. It was his second conviction, having served time in jail for sexually molesting two sisters under the age of 12 in 2009.

You might think it's a miscarriage of justice. Wealthy man with connections in high places and all that. Not so. I once collated a substantial list, replete with links and citations, of rapists being either dealt a symbolic period of incarceration or let off entirely. Judgements included comments like "she asked for it", "provocatively dressed", "he was drunk at the time, so diminished responsibility", "a custodial sentence/conviction might impact negatively on his career prospects" and so on. A few months ago I was about to add to to that list, but found it all too depressing and deleted it from the directory it festered in and from the backup.
