Water - ah, water! That will be the next big 'un, eh? L.A. is parched and the Imperial Valley is drying up, they'll be looking to Colorado and other watershed states to bail them out. Gotta keep those Hollywood swimming pools full, right?

This tells the history of federal ownership of lands west of the Mississippi. The feds bought some of it in the Louisiana Purchase, got more from England in the Oregon Compromise, and still more through a treaty with Mexico after the Mexican War.

The people of Nevada forever disclaimed any right or title to unappropriated US Public Land in 1864. This would include the Bundys.

ACT OF CONGRESS (1864) ENABLING THE PEOPLE OF NEVADA TO FORM A
CONSTITUTION AND STATE GOVERNMENT

Sec. 4. Authorization to form constitution and state government; limitations. And be it further
enacted, That the members of the convention, thus elected, shall meet at the capital of said territory on the
first Monday in July next, and, after organization, shall declare, on behalf of the people of said territory,
that they adopt the constitution of the United States. Whereupon the said convention shall be, and it is
hereby, authorized to form a constitution and state government for said territory: Provided, That the
constitution, when formed, shall be republican, and not repugnant to the constitution of the United States,
and the principles of the Declaration of Independence: And provided further, That said convention shall
provide, by an ordinance irrevocable, without the consent of the United States and the people of said
state:—
First. That there shall be neither slavery nor involuntary servitude in the said state, otherwise than in the
punishment of crimes, whereof the party shall have been duly convicted.
Second. That perfect toleration of religious sentiment shall be secured, and no inhabitant of said state
shall ever be molested in person or property on account of his or her mode of religious worship.
Third. That the people inhabiting said territory do agree and declare that they forever disclaim all right

at the sole and entire disposition of the United States

States residing without the said state shall never be taxed higher than the land belonging to the residents
thereof; and that no taxes shall be imposed by said state on lands or property therein belonging to, or which
may hereafter be purchased by, the United States.


Half baked modern attempts to reinterpret the US Constitution in a way designed to put vast tracts of US Public Land into the hands of an oligarchy most able to buy land quickly must overcome some tall obstacles, as 150-year old state enabling acts are typically quite wholesome.

Sounds like Bundy needs to read up on the laws of his own state, since he sees them as having priority over federal regulations.

Looks complicated, but rural areas smell and so do the people who live in them.

Cities have civilized intelligent people in them even if some are politicians.

So that makes it a lot simpler

Yeah well, the courts agree that Bundy's claims to the land have no merit. They also agree that Bundy needs to get his goddamn cows off the taxpayer's land and pay for a couple decades of the taxpayer's cattle feed that Bundy has already converted to cash.

Personal property rights flow from government, and are secured by government.
If a bunch of Gypsies and Travellers cut your fence and set up camp on your land, you'd like to think you could call the sheriff to defend your legal title to your land. How is the US Taxpayer any different than you?


This Bundy thing is not some sort of Libertarian Wounded Knee. He can move his cows, or find something else to do. If you want to fantasize, pretend he's in Detroit and his job just got offshored.

Fucking Left Coast has been bitching about Colorado River water since the 30s. Now they've got Mexico bitching about it too, since the Colorado river ends before it gets to Mexico now.

There is a multi-state "compact" regarding the Colorado River that allocates specific amounts to downstream states. I think this was a grave mistake on Colorado's part, agreeing to the compact. If the water falls on Colorado, it's Colorado's water and the lefties in California can drink seawater if their own mountains don't provide enough precipitation. After all, the Sierras get first shot at all that moisture flowing east anyway, why should they get any of ours?

There's a saying here in Colorado: "Whiskey's for drinking, water's for fighting." No small number of people have been killed for poaching water over the last 100+ years.

It's in part because Harry Reid's son entered into a deal with a Chinese solar power company that wants to build a solar installation in the valley and wants the cows out of there. Also, it seems that the desert tortoise was doing fine by eating the nice, healthy, moist cow flops for the last 140 years, and may not make it without them.

Actually, the Colorado thing reminds me of the constant bun-fight between 3 states here (Victoria, NSW and South Australia) about water usage from our biggest river, the Murray...
