The Conventions apply to a signatory nation even if the opposing nation is not a signatory, but only if the opposing nation "accepts and applies the provisions" of the Conventions.
A rational skeptic should be able to discuss and debate anything, no matter how much they may personally disagree with that point of view. Discussing a subject is not agreeing with it, but understanding it.

He probably was charged with breaking British military law and the Geneva convention. There's nothing "wanton" about killing a terrorist who has just tried to kill you in a gun battle. This wasn't a farmer tilling his field, this was someone who had engaged in hostile acts moments before. The Sergeant's mistake was in not shooting with his rifle from a distance because he saw the terrorist move towards his weapon. Doesn't pay to approach wounded terrorists anyway, they might well blow themselves and you up with a grenade or suicide vest. Best to just keep shooting at them till they quit moving for an extended period or brain matter can be seen through binoculars.
