They are.
Unfortunately, the State has always assumed control of intimate relationships between individuals. It's left over from our English heritage, where consanguinity meant everything in terms of legitimacy of both rule and inheritance.
One of these days I hope the State will get the FUCK out of the "marriage" business.
Absolutely the only rolls for the State as it pertains to relationships between individuals are the following:
Probate of inheritance
Child custody and control
Recording of domestic partnership contracts.
"Marriage" is itself an inherently religious concept and according to our Constitution Congress shall "make no law" regarding the free exercise of religion.
If it has a place in domestic matters, its place is as a recorder of the contractual obligations of the partners to a relationship contract and the protection of minor children. Nothing else.
Adjudications of contract violations should be by mandatory private arbitration, not civil court action.
