Well as far as I'm concerned no one under 14 should ever be charged with a heinous crime but that doesn't mean they shouldn't be locked up in a secure mental unit for a long time.
Lets be controversial Jamie Bulger murders who were 10 should never have been charged (and if had done the crime a couple of years earlier wouldnt have been).
In effect they never went to a real prison as such anyway (correctly)
The Bulger case is also different, in that all this kid did was pull a trigger on an adult. The Bulger killers beat a toddler to death.
I think that there is a huge difference.
While there is a market for shit, there will be assholes to supply it.

Meanwhile his family have won an appeal for a new hearing to determine whether he should be retried in a juvenile court. If such a trial is given the go-ahead, any sentence he is given will be served fully in a juvenile facility.

If they were tried today, they couldn't be tried as adults.

Indeed. Tried as adults, according to the same rigours principles of evidence and representation etc, but sentenced as children.
