UK Judge solves single mum problem

The woman had consented to sex, but only on condition that her husband withdrew as she did not want to become pregnant.

However, at the last minute he told her he was not withdrawing and told her 'because you are my wife and I'll do it if I want'.

The woman who did not want another child become pregnant after the incident in February 2010.

In his landmark decision Lord Judge ruled that because the man, the woman's husband under Sharia law, did not stick to his part of the pre-sex deal he could, in the eyes of the law, be held guilty of rape.
Women who lie about being on birth control are guilty of rape when the roles are reversed :{D I mean it seems logical :thinks:

Which should make trying to collect child support a fun, fun game :eddy:

Woman accuses man of fathering her child to collect child support.
Man claims women lied about being on the pill.
Woman arrested for rape :razzle:

And for bonus lolz.........

Man gets child, and the generous welfare and council house that goes with it. Woman stuck paying child support after jail :hehe:

Just when I think you couldn't get any more loathsome.

The judgement is actually that because withdrawal is not a reliable method of birth control no offence was committed. How the hell you reached the above conclusions is beyond me.

From what I gather the judge said if it happened accidentally no crime has occurred, but if the defendant made it clear was going to do it then it was rape.

That seems a reasonable decision
When only criminals carry guns the police know exactly who to shoot!

Perhaps it may seem reasonable, until you take it to it's logical conclusion. Women who try and "trap" a man by getting pregnant are guilty of rape if they misled their partner about being on birth control. A man would just have to claim, falsely or not, the woman told him she was on birth control and the police may be required to investigate that claim. Makes you wonder how many women could potentially be jailed under this ruling :{D

Lord Judge said that men who tried in vain to withdraw in time should not be pursued for rape, adding: ‘These things happen – they always have and they always will.
The ruling is almost unenforceable as either party could easily lie, and corroborating witnesses would be rare I think :{D The man could claim accident, that he never said he would not, or simply deny he sowed any seed there.

That judge got the top job because he is exceptionally good at his job.

My comment is not simply because he's Lord Chief Justice, but because I'm a lawyer and I see the impact of his judgments on a huge variety of issues. I'd say that he's the best LCJ we've had for decades.

The judgment (as reported by the Fail anyway) is completely compatible with rape legislation as it stands. Conditional Consent is a valid argument. When the condition is breached the consent is no longer valid.


Still - I note the Fail didn't print the actual judgment. I'm going to find it now.

The woman seems to have been married only in Sharia. No civil ceremony or process as I read it.

Lying to get someone into bed has never been a crime, lets face its probably the basis of human reproduction.

What you do once you get there can be a crime

But in current law, promising to withdraw and actually getting the girl preggers is lagally a rape, as it voids any consent the lady may have given.
