A local high court found a 46-year-old man not guilty of having sex with a runaway teenage girl, saying their liaison was neither forced nor in exchange for money.
The Busan District Court Wednesday upheld a lower court ruling that acquitted the man, identified as Kim, of charges related to the violation of the law covering the protection of minors.
Kim bought food for the 16-year-old girl, who was wandering near Seoul Station, and allowed her to stay at his home in December 2006. He was indicted for having sex with her while the two lived together for about six months.
``The girl had already been homeless for about two years before meeting Kim, and he did not control her after offering his house as a shelter to her request. So we don’t acknowledge the prosecution’s claim that Kim made the minor (engage in sexual activity) away from her parents’ protection,’’ the court said.
The court also found Kim not guilty of violating the laws governing the protection of adolescents, saying, ``They had sex, but she did not demand money and he did not give her money. He provided her with shelter, food and about 20,000 won pocket money, but there is no evidence that the offering was in exchange for sex.’
In Korea, a person is not guilty of any crime for having sex with a minor aged 13 and over unless it is paid for or forced. Sex with those under the age of 13 is punishable even if it is carried out under mutual consent.

I'm thinking, age of consent issue aside, that room and board could be legally considered as payment, even though it's not cash, couldn't it? But even if it were, she would probably do more time over a simple prostitution charge than he would.

Tip o' the iceberg, man. I used to tutor some lawyers who told me that not only was the age of consent 13 over here, that the only act legally recognized as sex is vaginal penetration with your penis. (No, not your penis! I mean that generically.) You can stick it anywhere else and it's neither sex nor rape. If it's forced anal or whatever, the most they could get you for is assault. Why should it be illegal for a 16 year old girl to have sex with anyone older? If it's forced, sure. But if it's her choice?

Actually, I don't see a problem with 16, assuming consent. When I mentioned the 'room-and-board = payment' thing I was thinking more of how an American court would/could interpret the law in order to prosecute. Legalistic interpretation/manipulation of the law fueled by sexually obsessed/repressed xtian moral codes. The 13-yr-old age of consent law does seem a bit on the young side, tho. Sure, some 13-yr-olds know what it's about and the potential consequences, but probably not all. Maybe not even half. Sex education over here is practically nonexistent. Which is the real problem, I suppose. Well, that and whatever caused her to run away from home in the first place, which was probably the tradition that a father has a Confucian right to beat the shit out of his children and spouse when they displease him or if he just gets drunk and is pissed off at his boss. Or something similar.

Anyway I wouldn't worry about it. I hate teenage girls. I find them more annoying than anything else. I usually don't be with anyone more than 5 years younger than me.
