Looks like downtown DC is largely unscathed. It's still shut down for the day. I'll venture out later - parking enforcement is suspended today so I can park anywhere!

Rainy and windy, but no more than a summer thunderstorm yet. Well, the wind's picked up. But people are still sometimes out and about.

Get this-- on my local parenting listserve, a mother was asking whether she really had to pay her nanny for today. "I asked her to come out, but she didn't. Now I have to work from home. What am I supposed to do?"

Thank gawd people on the listserve gave her the smackdown. I was worried they'd all be like, "Yes, that's terrible. How are you supposed to stay home and work if she won't come in from Queens or wherever? "

Well, the answer to her question is probably not. Nannies are nonexempt employees, which means that the employer has to track the nanny's hours and pay overtime for any hours over 40 the nanny works. By the same token, that means that the employer only must pay the nanny for hours actually worked, and if she is not at work, even because she takes the day off due to a hurricane, the employer need not pay her. Unless, of course, part of the nanny's deal involves paid time off, and the day could be considered a paid day off.

Yeah, yeah. It depends on the contract. There are salaried nannies in these parts, sometimes.

Nannies can earn a salary, but they are still nonexempt, which means they are always entitled to overtime. The only kind of exception would be a housekeeper or caretaker who is free to work in multiple homes, free to come and go as she pleases, and is not subject to the direction of the homeowner as to when and how her job is done. That is the rarity. Nannies almost always have to be at the house at a certain time, and stay until a certain time, and follow the directions of the person who hired him or her. That makes the nanny "nonexempt" irrespective of whether or not the nanny is paid on a salary or hourly basis. That means that the person hiring the nanny must pay overtime for all time over 40 hours worked each week, and by the same token means the nanny is not entitled to be paid for time she doesn't work because she is late or doesn't show up.

It was more the tone. Lady can't go in to work (because of the storm), but is upset at nanny because nanny can't come in (because of storm) so lady can get work done at home.

Well, if she's upset that the nanny can't get to work, then I agree with you. I think the lady ought to think a little more about the safety of the nanny rather than her own inconvenience. I'd not want anyone to take abnormal risks to come to the house to cook and clean. I might even volunteer to pay her for a day she missed, if she was an employee that I knew was normally one to go the extra mile.

Our lights are flickering-- according to the community listserve, that's happening all over. So we might lose power.

Oh, and there were some impressive transformer explosions, across the river in the Palisades. Apparently some people in the hood can smell the electrical fire.

There were fires all over the area there last night. There were too many fires for the NYFD to respond to.
