Generally you'll get a pass on shooting dead a home invader, but if you beat them to death, you're likely to face charges because you're just supposed to incapacitate them, not kill them after they are no longer a threat. Also, if they are close enough for you to smack them with a walking stick or a bat they are close enough to do the same to you, or stick you, or shoot you. My philosophy is that if they are closer than 600 meters, they are too damned close and I'm going to render them incapable of continuing the conduct that prompted me to shoot them in the first place as quickly and decisively as possible. After all, there may be more than one of them, and if you're busy beating the crap out of them, their cohort may just take the opportunity to do you in.
Quick and clean is always better tactics than messy and slow, however satisfying it might be to do it that way.
That's why I like Timothy Olyphant in "Justifed." He doesn't fuck around. He waits till he's authorized to shoot, and then he gets it done without any fanfare.

A 90-year-old Greenbrae man who was shot in the head during an alleged burglary has been sued by the alleged burglar.
Samuel Cutrufelli, who was also shot during the incident, claims Jay Leone "negligently shot" him during the confrontation inside Leone's home.
Cutrufelli, 31, claims Leone caused him "great bodily injury, and other financial damage, including loss of Mr. Cutrufelli's home, and also the dissolution of Mr. Cutrufelli's marriage."
Cutrufelli shot Leone once in the face during the alleged burglary, and Leone returned fire, hitting Cutrufelli several times. Both men were hospitalized for an extended period after the gun battle.
Cutrufelli, whose charges include two counts of attempted murder against Leone, is near the end of his criminal trial. The negligence lawsuit was filed on his behalf by his father and his criminal defense attorney.
Leone, reached at home Tuesday, said he was unaware of the lawsuit.
"He's the one who busted my door in," he said. "I'll just countersue him then. That's what I'll need to do."
The incident occurred at about 10:45 a.m. Jan. 3 at Leone's home on Via La Cumbre. Authorities said Cutrufelli entered the home, put a gun to Leone's head, tied his hands with a belt and rummaged through his bedroom for valuables.
Leone said he was able to wriggle his hands free, then convinced the burglar to let him use the bathroom. Then he got one of the five handguns stashed in his
bathroom, sneaked back to the bedroom and spotted Cutrufelli in his closet.
Cutrufelli allegedly fired his gun, hitting Leone in the jaw area, and Leone fired back. Cutrufelli then wrestled his gun away, put it to Leone's head and pulled the trigger, but no bullets were left in the gun.
When police found Cutrufelli bleeding in his car a short distance from Leone's home, he said he had shot himself and needed medical attention, Twin Cities police said.
Cutrufelli could face life in prison if convicted of the charges. His lawyer, Sanford Troy, said Cutrufelli is a methamphetamine user, that the incident was a drug deal gone sideways, and that Leone shot him in the back when he was trying to flee.
Cutrufelli, a father of two, is a Petaluma resident with Novato roots.

The burglar deserved whatever happened to him, of course. But the man who shot the burglar, Leone, was in no danger till he picked up a gun. Had he simply submitted, and let the burglar take his goods, no one would have been shot. Leone was lucky to survive, with a bullet to the head. It was totally unnecessary. Most of the time, submission achieves the best outcome. If the police are any good, they will get the burglar later.

You can't say that with any certainty. Many unarmed people are killed anyway, even if they submit. And since you can never tell whether this burglar is the one who's going to execute you to conceal his identity or just because he's a psychopath, it's always better to shoot back if you can. Leone's mistake was in only shooting once. He should have kept firing until the intruder was rendered incapable of continuing the behavior that justified shooting him in the first place. In Colorado, if you lawfully shoot an intruder in your home under our Castle Doctrine law, you are IMMUNE from both criminal AND civil suits. The real problem here is that it's California, which barely tolerates anyone owning a handgun at all, much less has a Castle Doctrine law to protect occupants against exactly these sort of frivolous and vexatious lawsuits. Even so, California is not the UK, and the case will almost certainly be thrown out of court, as it should be in ever such case.
Break into my house to commit a crime therein and offer ANY sort of threat of physical violence towards any occupant and I will exercise my rights under Colorado's Castle Doctrine law and shoot you till the white meat shows. And be immune from criminal and civil actions.

It really pisses me off. I'd call myself a liberal more proudly if liberals weren't so fuckign keen on coddling the assholes who intimidate, menace and rob others. I'll be among the first to help a criminal who wants to turn themselves into something better, but while they're committing crimes of intimidation and violence, fuck 'em.
What I've found with a few discussions I've had lately is this self-satisfaction that people express with their proffessed open mindedness. In realty it ammounts to wilful ignorance and intellectual cowardice as they are choosing to not form any sort of opinion on a particular topic. Basically "I don't know and I'm not going to look at any evidence because I'm quite happy on this fence."

This is a statistical truth based on the fact that most cases where a victim submits, no shooting happens. Police records show that this is true, not only most of the time, but almost all of the time.
However, the moment you draw a gun, all bets are off, and there is a more than 50% chance that you will get shot. The assailant may also get shot, as in this case, but the victim gets shot, and that is the point. So this makes the idiot who tried to draw a gun into a f%$#ing moron.
