I'm sorry, but thats a false argument. If you class every accident as stupidity, and totally the fault of the person it happens to, then there would be no need for any safety precautions. Cars would not need brake lights, because it's stupid to follow too closely. Guns would not need a safety catch. Roads would not need traffic lights. Nobody would need seat belts or air bags.
You wouldn't need child-proof doors on your car, or child-proof caps on your medicine.

Every accident involves some kind of stupidity in hindsight.
The point is that nobody's perfect at all times, and in the real world, we take account of that, and we expect major traders to take account of it.
When you buy a cup off coffee to drink in a car, it''s accepted by all that that car has to move, you don't sit in the drive through till you've finished. Anything can happen when a car is moving, causing an emergency stop, for example.

The buyer of coffee has a right to expect that they won't get serious burns, if an accident happens.
All Macdonalds have to do is sell the cofffee at a reasonable temperature.
While there is a market for shit, there will be assholes to supply it.

I gave you a detailed accounting of what exactly you said that supports our conclusions and you just shrugged it off as making logical leaps. Well yes, I suppose, if you consider the Pythagorean theorem a "logical leap" from the underlying axioms.

It's not a straw man. You set up that expectation yourself. They are the logical implications of the views you expressed (note "expressed" not "hold"). If you feel you didn't express yourself sufficiently, then feel free to elaborate. Alternatively, please point out where we're making logical leaps. Because otherwise it just sounds like cognitive dissonance...

Well, why don't you just explain it?

They didn't reach an impermissible conclusion, based on what you said. The conclusion they reached was not a necessary conclusion, but it was permissible - logically.

I think I get what you meant, which is that this particular instance was stupidity, but that doesn't mean that all accidents are stupidity or the responsibility of the injured person. Am I in the ballpark?
