Worker's Comp Available for Headboard Headaches!

The woman, who cannot be named, challenged the rejection of her workers' compensation claim for facial and psychological injuries suffered when a glass light fitting came away from the wall above the bed as she was having sex in November 2007.
The male friend said in his statement at the time that they were "going hard” and he did not know if they bumped the light or it just fell off.

Yes, it makes perfect sense that the employer would pay higher premiums because the employee is injured having sex.

:funny: Something VERY similar happened to me a few months ago, but unfortunately we were in my apt, no business trip. I got cut, but didn't even need stitches.

Put a damper on the activities, however. :(

Definitely. If she had been having sex in her own home rather than in a location where she was forced to be by her job, the injury would not have happened, or would have been on her dime.

When you're away from the home due to work related reasons, any accidents happening to you are work injuries.
and don't try to make me cry for the employer, I'm pretty sure it can afford the new premiums.

Dunno US law... but here, if I'm sent to somewhere by my job, say, to audit a customer, or for a training session, and I have an accident at my hotel, it's most definitely a work related one...

maybe she should have sued the hotel for being dangerous too, though... If I had to file suit over a hotel related accident on a work trip, my suit would certainly name both the hotel and my employer.
