United States District Judge Ronnie Abrams has ordered both sides to appear for an initial status conference on Dec. 16 at U.S. District Court in Manhattan. The lawsuit seeks $75,000 in damages.


These moves come after the plaintiff filed an amended complaint on Sept. 30 that includes a witness, “Joan Doe,” who states that during the 1994-95 school year, the plaintiff told her she was “subject to sexual contact” by Trump and Epstein.

The complaint also contains a declaration from a Tiffany Doe, who claims she was a party planner for Epstein and charged with finding attractive adolescent women to attend his parties.

Tiffany allegedly met the plaintiff at the Port Authority Bus Terminal, and persuaded her to attend the parties as a way to make connections that would launch her modeling career.

Tiffany allegedly witnessed Trump have four sexual encounters with the plaintiff, including one “where Mr. Trump forcibly raped her despite her pleas to stop.”

In federal civil lawsuits, basically, nothing can happen before that initial status conference. The Complaint was filed on September 30, and it took a few days for the filing to get straightened out because the plaintiff's lawyers are apparently fuck-ups who can't file a complaint without having to correct a series of "deficient filings." There were several deficiencies, the most glaring of which is that they didn't file a "civil cover sheet" which is required in every federal civil lawsuit filed in the United States. The requirement is known to any lawyer, and is clearly set forth in the local rules of court, and there is a form provided on the court website. You'd have to be a real idiot to forget that document.

After the deficiencies were corrected, on October 4, 2016, the court entered an order setting initial status conference where the parties are supposed to appear to discuss whether the court has jurisdiction, what discovery might be needed, what motions are contemplated, etc.

The attorneys then filed motions for "pro hac vice" admission to practice - meaning that attorneys not licensed in New York want to appear in the Southern District of New York via special permission from the court. Two lawyers submitting motions for permission to appear in the court on this case fucked up their filings and had to correct deficiencies. Pro hac vice admission just requires a form to be filled out, and you file it with the required fee, and the court grants the motion unless you've been disbarred or had problems elsewhere. A monkey could file it.

The plaintiffs also had "summonses" issued around October 7, 2016. A summons has to be issued to start a lawsuit. Filing the complaint does not mean Trump has to respond to it. First he has to be served with the papers. Looking at the court docket, a summons has been issued, but there is no "return of service" on file indicating that Trump has been served with the papers. Until that happens, the case has not begun, and Trump has no obligation to answer.

If he is served before the December 19, status conference, then the case can proceed. But, if he's not served, then Trump's lawyers will simply notify the court either immediately before or at the status conference that there has been no service of process and that conference will have to be rescheduled. There is a 90 day time limit to serve the summons and complaint, after which the case should be dismissed (without prejudice). Alternatively, if the plaintiff is having trouble serving Trump, they can ask the court for more time which is routinely granted.

If Trump ever has to respond to the Complaint, the first thing he'll do is move to dismiss it. I don't see how they get around the statute of limitations. Anonymous persons signed unsworn declarations filed with the Complaint in the case that they are claiming that the plaintiff was subject to threats which prevented her from filing suit. Apparently, those threats prevented her from filing suit for 20 years, but suddenly in this election year the threats don't prevent her from filing anymore.

So, there we have it. Looking at the papers, Trump may want to invoke Rule 11 against the attorneys bringing the suit.

There is some authority in the Southern District of New York that the filing of a civil complaint under pseudonyms does not commence an action. Federal Rule of Civil Procedure 10(a) and Roe v. New York, 49 F.R.D. 279 (S.D.N.Y. 1970). Where courts have allowed anonymous filings, the plaintiff generally seeks a protective order under Rule 26(c), but the Plaintiff in the Trump case hasn't filed a separate motion for protective order. Later cases after Roe v New York have shown that plaintiffs can, in unusual circumstances, which have to be established to the court's satisfaction, proceed under pseudonyms. However, that's an issue that remains to be decided in this case.

Indeed, if there is one thing that Hillary doesn't have, it's resources and lawyers, right? She's the David, to Trump's Goliath, that's for sure. Poor Hillary, relying on a dearth of monied interests in her camp, nobody to go to bat for her. She just has the President of the United States campaigning for her, the Attorney General pressuring the FBI to stop investigating her and meeting with her husband to discuss grandkids and vacations right in the middle of an FBI probe, she just has the media fawning all over her, sweeping any pesky issues right under the rug, with Politico and other reporters giving her campaign draft articles to review and approve prior to publication, she just has people giving her advance copies of questions to be asked of her at Town Hall debates/meetings, she just has the Chair of the Democratic National committee lying to the people and claiming to be neutral, all the while marshalling the resources of the Democratic National Committee to help Hillary defeat her chief rival, Bernie Sanders, she is just getting millions in donations from Friends of Bill and foreign governments, and she just has lawyers from the law firm that represents her get hired by the State Department to review emails to be released.... Obviously, the only lawyers available to work on the FOIA issues relative to Hillary Clinton's emails at State Department were Williams & Connelly lawyers, the firm that represents Hillary Clinton personally.

In a surprise ruling, a US district judge in Ohio issued a restraining order against Donald Trump's campaign to prevent anyone working on the campaign from harassing and intimidating voters at the polls on Tuesday.

The order came after a two-hour hearing in which the judge pressed Trump's lawyer to justify the candidate's inflammatory rhetoric about voter fraud. It also applies to close Trump adviser Roger Stone, who has organized poll-watching activities, and the "officers, agents, servants, and employees" of Trump and Stone.

Voter fraud has been a popular theme among Republicans this year, from Trump to state Republican leaders who cite fraud as a reason to make it more difficult to vote. But as Friday's ruling shows, it's a lot easier to warn about fraud on the campaign trail than in front of a judge.
