It's an interesting question whether it should matter.

I mean, if the company is hiring him to get the job done, and he's clearly getting it done to their satisfaction and more, then why should anyone care how he does it?

If you're a contractor - a key defining characteristic of your status as a contractor is the ability within the contract to assign others to do the work...

He should probably sue for breach of contract. Unless the contract specified no subcontracting he was perfectly entitled to cut his costs by outsourcing.

Probably should have set up a relay server at home and had the Chinese work through that.
