Special counsel Jack Smith skipped over the appeals court and brought the issue directly before the Supreme Court in an effort to keep the trial on a schedule.

The justices agreed to expedite the decision, but ultimately sided with the former president, who argued the case should be considered first by the District of Columbia Circuit Court of Appeals in a Jan. 9 hearing.

Conway said the D.C. court has “acted really, really, really fast” and said he would not be surprised “if we saw a decision from them in a matter of days.”

“I think if I were on that panel and I were the presiding judge, I’d be writing the opinion now because I just don’t think…there’s anything there to the claims that Trump has been making,” Conway said. Conway predicted that the D.C. court will lift the stay by the third week of January and teams can start preparing for trial as soon as March. If it were to return to the Supreme Court, Conway said a decision could come by June.

Doubtful. Whatever they decide, this is a big case and they're not likely to pass up the chance to influence the Supreme Court's thinking.

Trump team says Congress needs to impeach.
“Before any single prosecutor can ask a court to sit in judgment of the President’s conduct, Congress must have approved of it by impeaching and convicting the President,” they wrote. “That did not happen here, and so President Trump has absolute immunity.”

Trump’s team asked the appeals court earlier this month to examine the immunity ruling issued by Chutkan. Chutkan rejected Trump’s immunity claims, writing in an opinion that his “four-year service as Commander in Chief did not bestow on him the divine right of kings to evade the criminal accountability that governs his fellow citizens.”

Trump’s lawyers said Saturday that Chutkan “missed what the Founders recognized: That punishment of the President is irreducibly political and so belongs primarily to the branch most politically accountable—Congress and, ultimately, the Senate.”

You’d think they’d argue instead that any perceived criminal activity served US interests. It shouldn’t be too difficult then to show how bending/breaking laws is a norm… :dunno:
