The prosecutors in New York showed the same caution and restraint that Mueller's team displayed in Washington. It's almost part of the DNA of experienced prosecutors to tread carefully beyond areas where they can identify specific criminal behavior. This was why Trump's repeated invocations of the Democratic affiliations of Mueller's staff, while understandable, missed the point. (Most of Mueller's lawyers had made campaign contributions to Democrats over the years.)

The US constitution is clear that the date of elections will be set by Congress.

And in 1875, Congress set the date for the election in an unequivocal federal law:

"The Tuesday next after the 1st Monday in November, in every even numbered year, is established as the day for the election," the text reads.
No exceptions.

Joshua Douglas, an elections law expert at the University of Kentucky, says there's nothing in Trump's arsenal of powers that would let him rewrite that law.

"There is absolutely no way Trump could unilaterally change it," he said.

Not even an executive order or a state of martial law would change things in this instance. Legal scholars agree that the Supreme Court would step in quickly against it if he tried.

That's because the only body with the formal power to change laws in the US is Congress.

But don't count on Congress to move the date.

Any changes to the law would need to start in the US House of Representatives, which holds a comfortable Democratic majority.

Plus, senior Republicans in Congress (ie. the ones Trump would have to convince to delay the election) were pretty quick to say delaying the election isn't happening.

The US president cannot change the date of the presidential election. The US Constitution (Article II Section 1) unequivocally gives the power to set the date to the US Congress. In the 19th century Congress passed a federal law stating that the date of the presidential election would be the Tuesday after the first Monday in November of the election year.

The fuckstick toad Barr knows this perfectly well, so does the oleaginous religious zealot Pompeo, yet they both hemmed and hawed and eventually refused to affirm that it's the US Congress that has authority to set the date. To me this is definitive evidence that they're complete Trumpists who are willing to dispense with the US Constitution if that pleases his almighty Lardship and advances his agenda.

As Law&Crime has thoroughly explained before under slightly different contexts, the date of the U.S. presidential election is codified in federal statutes. 3 U.S.C. § 1 sets the date as follows: “The electors of President and Vice President shall be appointed, in each State, on the Tuesday next after the first Monday in November, in every fourth year succeeding every election of a President and Vice President.” Similarly, 2 U.S.C. § 7 sets the date for the election of U.S. senators and representatives on the same day. In other words, the date cannot be changed without Congress changing the laws which set the date. The Senate is controlled by Republicans; the House is controlled by Democrats. It is unlikely the parties would come to a compromise which would allow the election date to be moved.

Note the original date* on which the document with these allegations was entered into the docket. The actual document may not have been available to the public, but the allegations have been known for some time. I haven't looked up the exact date this made some headlines, but it's been public knowledge for at least a couple of years that there was an accusation by 'Jane Doe' (who I assume is Virginia Giuffre) that as one of Epstein's victims she also was a victim of Mr Dershowitz's attentions. What am I missing?

I expect that in at least one of the linked posts by our absent Trumpist member, he was downplaying those very allegations.
