The commander of a Navy submarine was relieved of duty last summer after admitting to investigators that he paid for "female accompaniment" while the boat was in port in the Phillippines."

Was it legal in that jurisdiction? If it wasn't, then, whatever the moral stuff, a senior Naval guy should not break the law in a foreign port, and that will be why he was caned...

I'm not saying that I agree with the outcome, but that would be the legal process within the US Navy, surely. If hiring prostitutes in a foreign port was in fact legal there, and the captain wasn't actually organising orgies in the wardroom, then he shouldn't be penalised. If, however, he broke the law (unenforced or not) then he has to cop the consequences...

The prohibition on hiring prostitutes got added to the UCMJ by the G. W, Bush administration.
Under the Uniform Code of Military Justice (UCMJ), hiring a prostitute wasn't specifically banned until 2006 – as part of the Bush administration's effort to combat human trafficking, which frequently is connected to prostitution (including the involvement of underage girls).

“Under a change in the Manual for Courts-Martial, troops who patronize prostitutes can receive a dishonorable discharge, forfeiture of all pay and allowances and up to a year in jail,” the Marine Corps Times reported when the change took effect.

The specifics of “prostitution” and “pandering” are spelled out in Article 134 of the UCMJ, as are the circumstances under which such activities are “to the prejudice of good order and discipline in the armed forces or … of a nature to bring discredit upon the armed forces.”

It makes no difference if prostitution is legal – as it is in parts of Colombia, near the largest NATO base in Germany, parts of Nevada, and other areas around the world where thousands of US service personnel are posted – purchasing sex still is outlawed by the US military.

It's weird that they changed the rules after so long. My dad was a career Navy man, and he used to joke how the sick bay used to stock up on penicillin for port calls. Of course, that was the enlisted guys. Commissioned officers were held to a different standard. Of course, that was decades ago.
