Me too. People in that stratum of society have sufficient influence to organise a suitable judge to preside over the appeal. "Judge shopping" is a thing. Money need not necessarily be involved. An old boys network can suffice, manipulating certain levers in bureaucratic organisations.

If the appeal is pending (filed) then there are already judges assigned, I would think. But that judge shopping can occur beforehand -- someone needs to bribe someone in the clerk's office to "randomly select" the right panel of judges. Of course, that's a pretty serious crime, so these matters are handled delicately, with plausible deniability.

There is a period between the announcement of the intention to lodge an appeal and the assignment of a judge. And no, bribery is not necessary. A sympathetic ear will do. Anyway, the Court of Appeal will hear Cardinal Pell’s application for leave to appeal on the 5th and 6th of June and, if it grants that first hurdle, the appeal itself. It could be weeks later that the Court of Appeal judges return to announce whether the challenge is successful. Plenty of time for musical chairs - judges inexplicably falling sick, sudden scheduling problems and a raft of other options are available to engage in a bit of shopping.
A solicitor I know told me about the occasion where the air contitioning broke down the day before a hearing. All other courts were booked out. The hearing had to be rescheduled. The assigned judges were not available on the new date. When their replacements were not deemed suitable by the plaintiff, the audio equipment ceased working and the hearing had to be postponed again, yes, with yet another set of judges. Then the plaintiff was hospitalised with some ailment. After that an important witness had died. No suspicious circumstances, but in the end the case was actually abandoned. Both sides agreed that the prospects of coming to a sensible conclusion had vanished.

Contrary to my expectation Cardinal George Pell has lost his appeal at Victoria's Court of Appeal against his conviction of five sex crimes, on of which was sexual penetration of a child. Two of the three judges upheld the conviction. One of the 13 reasons given by his defence team was that the cardinal could not possibly have committed the offences because his clerical robes were too heavy to be moved aside to commit the sexual acts he was convicted of. Two of the three judges dismissed all 13. The six year jail sentence will remain, although its non-parole period runs out in October 2022.
Waiting now to hear that Pell will take the next step open to him: To lodge an appeal with the High Court in Canberra.
