Supreme Court Strikes Down Texas Abortion Restrictions

Post by rasetsu » Mon Jun 27, 2016 9:42 pm

The Supreme Court on Monday struck down parts of a restrictive Texas law that could have reduced the number of abortion clinics in the state to about 10 from what was once a high of roughly 40.

The 5-to-3 decision was the court’s most sweeping statement on abortion rights since Planned Parenthood v. Casey in 1992. It applied a skeptical and exacting version of that decision’s “undue burden” standard to find that the restrictions in Texas went too far.

The decision on Monday means that similar restrictions in other states are most likely also unconstitutional, and it imperils many other kinds of restrictions on abortion.

5-3 smackdown. Time for Republicans to find some other way to get votes, because this isn't an issue they can argue anymore.

The Supreme Court still has some rules, and is likely to strike down some or most of the law. They are very particular about "standing" and this is where the law is weak.

Guardian:
A citizen’s prize for a successful suit would be $10,000 and attorneys’ fees. Defendants would not be able to recoup any such losses. Lawmakers also rewrote the rules of civil litigation to favor these new bounty hunters, allowing anyone anywhere to sue. In doing so, legislators tossed into the fire the foundational principles of “standing” (you actually need to be involved to sue) and venue (one of the parties must live or work where the suit is filed).

Daily Mail
Donald Trump wouldn't say whether he agrees with the Supreme Court ruling upholding a new Texas heartbeat law that bans abortion after six weeks – or when a fetal heartbeat can be detected.

In his first on-camera interview since leaving office, Trump said the ruling is likely temporary.

'I know that the ruling was very complex and also probably temporary,' the former president told Sharyl Attkisson in an interview taped Saturday in Bedminster, New Jersey. 'I think other things will happen and that will be the big deal and the big picture.'

There is no heartbeat at 6 weeks.

Are there other tests (blood, urine, saliva or whatever) that can detect pregnancies well before 6 weeks?

You would waste all sorts of money on tests, so the morning after pill is probably the safest bet.

Home pregnancy tests work 10 days after intercourse. But taking 7 tests ina row would cost a bit. Three, in 6 days might give you the result.

Thanks, Tero. Perhaps women's health groups in Texas may be able to give women who need it concrete advice on how to terminate an unwanted pregnancy within the letter of that State's misogynist law...
