In clear violation of the 4th Amendment.
"under Florida v. J.L. (March 28, 2000), “the U.S. Supreme Court affirmed that anonymous tips are not sufficient grounds to constitute probable cause for a search. Judge Ginsburg, writing for the Supreme Court, stated, “Such an exception would enable any person seeking to harass another to set in motion an intrusive, embarrassing police search of the targeted person simply by placing an anonymous call.…”
So, these are the fucking scum bags I'm supposed to trust my life with?
I think not.

Here's the problem: The police DO have a right to enter a premises without a warrant under the "exigent circumstances" exception to the search warrant rule if they have a reasonable belief that a crime is in progress or someone's life is in danger. The standard for exigent circumstance entry is NOT probable cause, it's "reasonable belief," a much lower standard of evidence.Collector1337 wrote:http://www.informationclearinghouse.inf ... e34948.htm

So, since the occupant was refusing entry on what appears to be a domestic violence call, and it is reasonable for a police officer to believe that if such a complaint is made that there may be an injured or endangered person inside, they DO have the right to demand and even force entry. Their actions within are limited to freezing the situation pending investigation and a protective sweep of the residence to look for other persons and weapons. Anything in plain view is admissible, but they cannot rifle through closed containers or generally search the house without probable cause.
But here's where the cocksucking cop screwed up. They tased the wrong person! They had authority to subdue the vocal male who was refusing them entry, and to restrain the woman too, but they didn't have cause to tase her merely because she was filming them. They could have ordered her to sit down, they could even have handcuffed her under some circumstances, but the guy is right, it's NOT illegal or even improper to film the police, and the use of a taser was excessive.

It wasn't a domestic violence call, it was a noise complaint.Seth wrote:Here's the problem: The police DO have a right to enter a premises without a warrant under the "exigent circumstances" exception to the search warrant rule if they have a reasonable belief that a crime is in progress or someone's life is in danger. It'd be the most hilarious domestic violence call ever since the wife is right there with her husband telling them to go away.
You are right about exigent circumstances, but there wasn't any.

A rational skeptic should be able to discuss and debate anything, no matter how much they may personally disagree with that point of view. Discussing a subject is not agreeing with it, but understanding it.
