Obama called to Georgia court to defend primary eligiblity
Obama called to Georgia court to defend primary eligiblity
Obama has been summoned to a Georgia administrative court to face a claim that he is ineligible to run in the Georgia presidential primary because he is not a "natural born citizen" as the Constitution requires.
This is the first "birther" case to be brought to trial, and it's a very, very strong case.
The claim is based on the Constitution's requirement that to be President, a person must be, among other things, a "natural born citizen." According to two separate Supreme Court cases, a "natural born citizen" is a person born in the United States to two parents who are also citizens of the United States. It is undisputed fact that Obama's father was a British citizen (out of Kenya, a British colony at the time), and never became a US citizen, and therefore Obama is not eligible under Georgia law to run in the presidential primary.

and to the general issue:

This case, in which the judge has turned down Obama's request to quash the summons, could sink Obama's reelection, because if this court finds he's not eligible to run, it will spread like wildfire through the other states and eventually end up in a suit challenging his right to hold the office RIGHT NOW. He could easily be expelled from the office in addition to being prohibited from running again.
Like it or not, the precedents, the law, and the Constitution are with the "birthers" this time.
Say bye-bye to Obama.

Seth has another premature ejaculation.
All rights have to be voted on. That's how they become rights.

Nothing, except then he won't be on the Georgia ballot, which will trigger other complaints in other states (if it hasn't already) challenging his eligibility. If he fails to get on enough state ballots, he will lose.Warren Dew wrote:What's to stop him from just ignoring the Georgia primary?

Re: Obama called to Georgia court to defend primary eligibli
Georgia isn't redefining anything. The Supreme Court defined it, and it means having two parents who are both American citizens. Georgia is merely applying precedent, which is why it's such a strong case.maiforpeace wrote:Fuck the Constitution...let Georgia redefine what a natural born citizen is?Seth wrote:Obama has been summoned to a Georgia administrative court to face a claim that he is ineligible to run in the Georgia presidential primary because he is not a "natural born citizen" as the Constitution requires.

As I said, if he ignores the Georgia primary, he will not appear on the Georgia presidential ballot, and the Republican will run unopposed (unless someone else files in time who is qualified to run), and Obama will lose all 15 Electoral votes, which could easily cost him the election. That's exactly WHY we have the Electoral College, so that candidates cannot simply ignore the smaller or less populace states.Exactly Warren.
