I am sure they will, and if police stop people because of their race, as opposed to a reasonable suspicion of whether they are lawfully in the country, it will be a good lawsuit. I am sure they will also make constitutional arguments about whether States have the power to make this kind of law, or whether it is inherently a federal matter. As I started this thread, the Constitution does not say that the federal government has the power to regulate immigration, but there is a Supreme Court case that gives it that power. The question is, is that power exclusive or can the States, under their general police powers, criminalize illegal presence in the US.

What's really silly though is the knee-jerk cries of racism here. Most immigrants getting green cards are Mexican and most green card holders getting citizens are mexican and overall most immigration to the US is from Mexico. This country, the US, does NOT discriminate against Mexicans. They are welcomed in numbers far greater than from any other nation on the planet - if that is discrimination, someone is going to have to explain how.
And, nobody yet has been able to explain to me why the US should be obligation to allow people to stay in this country who knowingly break its immigration laws.

Well, right. I'm not sure why someone would not agree with the "spirit" of the law, since the "spirit" of the law is that people who come into the United States illegally should not do so and if they are discovered they should be removed. The problem is not the "spirit" of the law, the problem is the difficult application of the law because police may see someone who looks Mexican or has an accent and use that as "reasonable suspicion" that one is an illegal alien.Martok wrote:I saw a republican "strategist" on MSNBC. I certainly understand people's objections or questions regarding this law. After all, natural born Americans can't usually prove their citizenship very easily. I mean, proof of citizen ship is a passport or a birth certificate - not a drivers license. There's no requirement that a person have a drivers license, unless one wants to drive a car. You don't even technically have to have a social security number. So, how is a police officer to know when to arrest someone? That's a fair question.
However, there was an executive order in Arizona confirming that race and ethnicity can not be used to determine "reasonable suspicion" and the law does not go into effect until the State Police come up with a reasonable policy for enforcement. So, so far, it certainly doesn't seem as if anyone's rights have been violated. If someone thinks they've been singled out because of their race, then they will have a nice lawsuit against the police department under 42 USC Sec. 1983 for civil rights violations under color of law.
