All judges in all courts? Including the ones appointed by Republicans and Trump himself? Seems to me that Ted is just thinking ahead. Apart from his base Trump isn't really embedded in the nitty-gritty of US politics like Ted and probably isn't that interested in playing even a bit part, so cultivating favour with Trump voters now might be useful later.

Ted's Republican in a way Trump never was and probably never could be, or wanted to be. Whatever Trumpism is it isn't going away, and with Pence now throwing in his lot with Ted et al this looks like a politically quite understandable move to keep Trump supporters identifying with the Republican brand.

Ted's got a legal background, and he's relatively young - he can take a loss for the team now. In a way it's better if his legal bid does fail. At least that way he can say that they really really tried but were thwarted by the forces of evil at every turn. Then they can make the next four years about seeking justice for the true American patriots whose votes were stolen in 2020. And if he plays his cards right then you never know: Ted could even be Pence's running mate in 2024.
