...As attorneys Todd Garvey and Brian Yeh wrote in the report, Washington has flexibility regarding drug prosecution, stating, “The extent to which federal authorities will actually seek to prosecute individuals who are engaged in marijuana-related activities in Colorado and Washington remains uncertain. President Obama himself has suggested the prosecuting simple possession is not a priority, while the Department of Justice has said only that ‘growing, selling or possession any amount of marijuana remains illegal under federal law.’”

What is more certain, they wrote, is that federal firearms regulators will be aggressive about banning anyone who uses marijuana from buying – or possessing – a weapon.

“With the legalization of marijuana for recreational purposes in Colorado and Washington, it seems likely the ATF will … consider a recreational user of marijuana to be a prohibited possessor of firearms regardless of whether the use is lawful under state provisions,” they wrote.

The attorneys said the ATF specifically has stated, “any person who uses or is addicted to marijuana, regardless of whether his or her state has passed legislation authorizing marijuana use for medicinal purposes, is an unlawful user of or addicted to a controlled substance, and is prohibited by federal law from possessing firearms or ammunition.”

They further wrote, “These individuals are to answer ‘yes’ when asked on the firearms transfer form if they are unlawful users of a controlled substance.”

Answering falsely, of course, is also a felony.

Much could accomplished overnight if the US Attorney General were to exercise his discretionary power to downgrade marijuana to Schedule III under the Controlled Substances Act

Even if it were done in old Melbourne town, it would be too late for me, having given up the weed because it provoked mini-epileptic fits towards the end...

However, probably a fairly rare reaction, so enjoy, Colorado dudes!

The Federal government won't go after State's pot laws because the Feds are afraid that Federal drug laws would be ruled unconstitutional under the tenth amendment. That could cause big headaches because of everyone currently in prison on federal drug charges.
A rational skeptic should be able to discuss and debate anything, no matter how much they may personally disagree with that point of view. Discussing a subject is not agreeing with it, but understanding it.

So, turns out the state AG checked with the feds and it is legal for pot shop owners to hire armed security guards, which they immediately did...according to the Denver Post mostly Iraq and Afghanistan military vets. Not sure about the battle-rattle though, they probably don't want to scare off the pot-heads.

Insofar as state laws on the subject are concerned, you're probably right but only because the states are now asserting their 10th Amendment rights to a much greater degree than they have for nearly a hundred years. One of the reasons that Illinois now has a concealed carry law is that the courts ruled that 49 other states couldn't be wrong about the issue of law-abiding citizens being licensed to carry concealed handguns. The court explicitly said that in fact in holding that Illinois was required to pass some sort of law that allowed for concealed carry licensing...even if, like New York City, it's practically impossible to actually obtain one.

Which is the beauty of our system. When the states decide the federal government has intruded too far on state's rights, they can constrain Congress merely by ignoring them and challenging the feds to stand up and fight. Usually the feds back down, as they did with Prohibition and are now doing with respect to marijuana.

Hey, they need the protection and I need to pay for the kit. Sounds like a win-win situation.

Family Vacation

As for carrying 30-round clips on a road trip to score some OTC gange in Denver, why is extended capacity magazines such a major vacation priority?

You know, showing up at the weed dispensary with an assault rifle and chest rack and grenades and canteens and toilet paper and shit, like goddamn Rambo.

Thing was, Seth made that statement in reply to a post of mine about the chickenshit BATF and the US Attorney General, which was made in response to laklak's concerns about what size magazines he can use in his assault rifle when he maybe visits Colorado on a family vacation junket.
As you know, legal magazine size is always a major priority when planning next summer's holiday.

I wonder if anyone notices the issue of giving up 5th Amendment rights against self-incrimination to exercise rights under the 2nd to buy a firearm?

It will be a state by state thing. You won't even be able to ship it state to state even both states allow it. The DEA will prevent that.
