Hale says prorogation is not a proceeding in parliament.

Although it takes place in parliament, it is not their decision. It is something that has been imposed on them from outside.

The PM’s advice to Her Majesty was “unlawful, void and of no effect”.

That means the order in council was also “unlawful, void and of no effect”.

That means the prorogation had no effect. She says it is as if the royal commission had no effect.

Parliament has not been prorogued, she says.

She says it is for the Speaker to decide what happens next.
Since Johnson is in America, will he stay there to avoid the consequences?

The Daily Mail is conflicted. It obviously has to pitch the decision as both an affront to Boris' authority as well as acknowledging the legally binding nature of the judgement, but it still pulls one out of the bag.
Boris Johnson was humiliated in the Supreme Court today as judges ruled unanimously he illegally prorogued Parliament to 'frustrate' debate on Brexit - and MPs are set to return to the Commons immediately.

Lady Hale said the Prime Minister's decision to ask the Queen to shut down the Commons for five weeks was 'unlawful, void and of no effect'.

The Supreme Court president said: 'The court is bound to conclude therefore that the decision to advise Her Majesty to prorogue was unlawful because it had the effect of frustrating or preventing the ability of Parliament to carry out its constitutional functions', adding: 'Parliament has not been prorogued'.

Arch-remainer Gina Miller, who helped defeat Mr Johnson, hugged her lawyer Lord Pannick QC in the courtroom as her victory was confirmed.

Today's extraordinary Supreme Court judgment will have seismic consequences over whether the political power of the Prime Minister built up over centuries can be neutered by the courts.

It also delivers a sledgehammer blow to his promise to take Britain out of the EU on October 31 'deal or No Deal' with remainer MPs ready to take control of the process.

Mr Johnson, who is 3,500 miles away from London meeting President Trump in New York today, has already vowed not to resign from No 10 if he loses the case and is found to have misled Her Majesty.

And in a sensational stand-off the PM will be considering whether he can legally defy the court and ask the Queen to prorogue Parliament again. ...
